NOTICE OF PRIVACY POLICIES AND PRACTICES
Kleinberg Benefits, Inc. Insurance Services (“KBI”) is firmly committed to protecting your privacy. This Initial Privacy Notice describes how KBI collects, discloses and protects the personal information we gather about you. We may at any time materially change our privacy policies and procedures. If we do, we will notify you before we make changes.
We gather two types of protected information about you: 1) Nonpublic personal information (“NPI”); and 2) nonpublic personal financial information (“NPFI”). NPI includes any list or description of persons with personally identifiable information not publicly available. It includes the medical, financial and character information that we gather to provide you with insurance as well as your name and address. NPFI is the protected financial information we gather about you and may include salary information.
OUR PRIVACY POLICIES AND PROCEDURES
Categories of Nonpublic Personal Information We Collect. We collect several types of Private Information, including
Information for census collection. This may include employee name, social security number, age, birth date, gender, home zip code, dependent status, job title and/or salary;
Claim data for experience purposes;
Employee claim information. This may include health condition (if required for resolution), patient’s name, patient’s address and/or telephone number, physician/medical group, service date, claim problem, social security number of insured and dependent (if involved), and any other information needed to solve a claim problem when given written authorization to do so; and
Information needed to carry out our day-to-day duties with you, including:
- Survey data you may request;
- Employee list billing information and payment history;
- Administration,
- Insurance transactions and
- Enrollment/disenrollment information (including name, address, age, social security number, income, beneficiaries, plan choices, doctor choice, coverage dates, health conditions, dependent information, etc.) included on enrollment and other forms.
- Information obtained from our Website
What We May Disclose. We may disclose all the information that we collect about you. However, we only disclose the minimum necessary to perform our duties for you.
To Whom We Disclose. KBI does not share your information with our affiliates. However, we may share your nonpublic personal information in our day-to-day business practices with the following third parties:
- Insurance Companies
- Managed Care Companies
- Administrative Companies
- Brokerage/Insurance Agents, including general agents
- Physician Offices & Medical Groups
- Legal Offices
- Web Service Providers
These other third parties may have access to client information (such as Identifying Information) needed to perform their business, insurance or professional functions involving you, but they are not authorized to use it for any other purposes.
When We Are Allowed To Disclose. We are allowed or required to disclose NPI and/or NPFI in the following situations:
With your written authorization.
- When it is necessary for us to do our business, and the non-insurance entity agrees not to disclose the NPI and/or NPFI.
- If the disclosure helps the insurance company perform an insurance transaction for you. They may also share it if it is reasonably necessary to detect or prevent criminal activity, fraud or misrepresentation connected with an insurance transaction.
- To verify coverage or benefits, conduct operations or conduct service audits from a medical professional.
- As is required or permitted by law, to the Department of Insurance, law enforcement, or other governmental entity. This may include an administrative or court order.
- To conduct actuarial or research studies, if there are proper safeguards.
- To aid in the sale of whole or part of an insurance business.
- To report claims experience to a group policyholder or do an audit.
- To inform a certificate holder or policyholder of the status of an insurance transaction.
- To have a professional peer review organization review medical care.
- To have the government determine eligibility for health benefits.
- To protect the interests of a lien holder, etc. or any other person having a legal interest in an insurance policy, if that disclosure is needed.
Former Customers. We do not share private information about our former customers, unless we receive written authorization to do so from the former customer.
Opting Out of NPFI Disclosure to Nonaffiliated Third Parties. We may share NFPI to nonaffiliated third parties for your benefit plan’s marketing purposes. If you do not want us to disclose NPFI about you to nonaffiliated third parties, then do not sign any notice you receive from us asking you to allow us to use your NPFI on your behalf.
How We Protect the Confidentiality and Security of NPI and NPFI. Access to nonpublic personal information about you is limited to our employees and the other parties described above. We protect and safeguard your NPI and NPFI. We maintain physical, administrative and technical safeguards that meet or exceed federal standards to guard your nonpublic personal information. Our written Privacy Policies and Procedures document is available upon request.
Your Right to Access, Copy, Review and Request Correction of NPI and/or NPFI. You have the right to access, copy, review and request correction of any NPI and/or NPFI in our possession. You must make this request to us in writing. We have 30 days to allow you to review your NPI and/or NPFI. If you believe that there is an error in the information, you may request in writing that it be corrected. We have 30 days from receiving the request to make the correction or to tell you the reason why we will not make the requested change. If you disagree with the refusal, you may supply us with a brief statement why you disagree and it will be filed with your NPI and/or NPFI.
